These terms apply when a merchant installs and uses the Ordersmith app for Shopify, provided by JHR Tech Ltd, registered in England and Wales (company number 13909496), registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ ("we"). By installing the app you agree to them on behalf of your business.
1. The service
Ordersmith adds checkout and after-purchase features to your Shopify store, including drop-off point selection, order editing, shipping rules, mobile number checks, basket shipping estimates and parcel tracking. Some features depend on your Shopify plan (for example, the drop-off map in checkout needs Shopify Plus) and on third-party services such as carriers.
2. Your account and responsibilities
- You must be authorised to install apps on the store and to agree to these terms for its business.
- You're responsible for your settings, including shipping prices, rules, change windows, which edits customers may make, and any carrier account you connect.
- You're responsible for your relationship with your customers, including your own privacy notice, delivery promises and refunds policy. The app follows the settings you choose.
- You'll check orders before fulfilling them where the app flags something (for example an unverified drop-off point or a failed refund).
- You won't misuse the app, try to access other stores' data, or interfere with how it works.
3. Fees and billing
Prices and any free trial are shown on the app's Shopify App Store listing. Charges are billed by Shopify through your Shopify invoice. You can stop using the app at any time by uninstalling it; charges end then. We'll give at least 30 days' notice of a price increase.
4. Refunds and payments the app handles
When order editing is on, the app can refund customers to their original payment method and collect extra payments through Shopify's payment page, based on your settings. Refunds and payments are processed by Shopify and your payment provider. If an automatic refund fails, the app tells you, and you remain responsible for refunding the customer.
5. Data and privacy
We handle information as described in the privacy policy. For your customers' information we act as your processor, only on your instructions (given through the app's settings) and only to provide the service. When you uninstall, we delete the data we hold as described there.
6. Availability and changes
We aim to keep the app available and working, monitor it continuously, and keep backups, but we can't promise it will be uninterrupted or error-free. Carrier services, Shopify and other providers can be unavailable; when a carrier is down the app hides drop-off options so checkout keeps working. We may improve or change features; if a change significantly reduces what you're paying for, we'll tell you in advance.
7. Liability
Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or fraud. Otherwise:
- We aren't liable for indirect or consequential losses, or loss of profit, revenue, goodwill or data.
- We aren't liable for failures of Shopify, carriers, payment providers or other third-party services.
- Our total liability in any 12 months is limited to the fees you paid for the app in those 12 months.
8. Ending
You can end these terms at any time by uninstalling the app. We may suspend or end access if you breach these terms or misuse the app, or if we stop offering it, giving reasonable notice where we can.
9. General
We may update these terms; we'll post the new version here and tell you about significant changes. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. Contact: support@jhrtech.uk.
